Terms of Use

These Terms of Use (the “Terms” or “EULA”) form a legal agreement between you and Lodehed Labs (Jesper Lodehed), Sweden (“we”, “us”, “our”) governing your use of the Klaks! application and these app pages (together, “Klaks”). By downloading, installing, or playing Klaks!, you agree to these Terms. If you do not agree, do not use Klaks!.

1. Licence

We grant you a personal, non-transferable, non-exclusive, revocable licence to download and play Klaks! for your own personal, non-commercial purposes on Apple-branded devices that you own or control, in accordance with the App Store Terms of Service and the Usage Rules set out in Apple's media services terms. You may not copy, redistribute, sell, rent, sublicense, reverse engineer, or attempt to extract the source code of the game, except to the extent such restriction is prohibited by applicable law.

2. Purchases and the one-time unlock

Klaks! is free to download, and the first levels are free to play. The full game is unlocked by a single one-time in-app purchase — there is no subscription and no recurring charge. All purchases are processed by Apple through the App Store; pricing is shown in the game before you buy and is charged to your Apple Account. You can restore a previous purchase on your devices using the same Apple Account. Because the purchase is a one-time unlock, there is nothing to cancel. Refunds for App Store purchases are handled by Apple under its media services terms.

3. Game progress

Your level progress, hints, and unlocked themes are stored on your device. We are not responsible for loss of progress caused by deleting the app, changing devices, or device failure. Your purchase of the full game can always be restored through your Apple Account.

4. Acceptable use

You agree not to misuse Klaks!. In particular, you will not:

• use Klaks! for any unlawful purpose or in violation of any applicable law;
• attempt to interfere with, disrupt, or gain unauthorized access to the game or related services;
• use the game in any way that could damage, disable, or impair it.

5. Intellectual property

Klaks!, including its name, design, levels, code, and content, is owned by Lodehed Labs and is protected by intellectual-property laws. These Terms grant you a licence to play the game; they do not transfer any ownership rights to you.

6. Disclaimer of warranties

Klaks! is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the game will be uninterrupted, error-free, or that it will meet your requirements. Nothing in these Terms limits any statutory rights you may have as a consumer that cannot be excluded under applicable law.

7. Limitation of liability

To the maximum extent permitted by law, Lodehed Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of (or inability to use) Klaks!. Where liability cannot be excluded, our total liability is limited to the amount you paid for the game, if any.

8. Apple-specific terms

The following terms apply because Klaks! is distributed through Apple's App Store. You acknowledge and agree that:

• The agreement is with us, not Apple. These Terms are between you and Lodehed Labs only, not Apple. Lodehed Labs, not Apple, is solely responsible for Klaks! and its content.
• Scope of licence. The licence granted to you is limited to a non-transferable licence to use Klaks! on Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
• Maintenance and support. Lodehed Labs is solely responsible for providing any maintenance and support for Klaks!. Apple has no obligation to furnish any maintenance and support services.
• Warranty. Lodehed Labs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Klaks! fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Klaks!.
• Product claims. Lodehed Labs, not Apple, is responsible for addressing any claims relating to Klaks!, including product-liability claims, claims that Klaks! fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar legislation.
• Intellectual property. In the event of any third-party claim that Klaks! infringes that party's intellectual-property rights, Lodehed Labs, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “last updated” date above. Significant changes will be reflected in the game or its release notes. Continuing to play Klaks! after a change means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of Sweden, without regard to its conflict-of-laws rules, and subject to any mandatory consumer-protection rights in your country of residence.
