Terms of Use

These Terms of Use (the “Terms” or “EULA”) form a legal agreement between you and Lodehed Labs (Jesper Lodehed), Sweden (“we”, “us”, “our”) governing your use of the Vana: Forgiving Habits application and these app pages (together, “Vana”). By downloading, installing, or using Vana, you agree to these Terms. If you do not agree, do not use Vana.

1. Licence

We grant you a personal, non-transferable, non-exclusive, revocable licence to download and use Vana for your own personal, non-commercial purposes on Apple-branded devices that you own or control, in accordance with the App Store Terms of Service and the Usage Rules set out in Apple’s media services terms. You may not copy, redistribute, sell, rent, sublicense, reverse engineer, or attempt to extract the source code of the app, except to the extent such restriction is prohibited by applicable law.

2. Purchases and the one-time unlock

Vana is free to download and use on its core features. Premium features are unlocked by a single one-time in-app purchase — there is no subscription and no recurring charge. All purchases are processed by Apple through the App Store; pricing is shown in the app before you buy and is charged to your Apple Account. You can restore a previous purchase on your devices using the same Apple Account. Because the purchase is a one-time unlock, there is nothing to cancel. Refunds for App Store purchases are handled by Apple under its media services terms.

3. Health and wellbeing disclaimer

Vana is a habit-tracking and motivation tool. It is not a medical device and does not provide medical, psychological, or professional advice. Information in the app (including any insights derived from Apple Health data) is for general informational purposes only and should not be relied on as a substitute for advice from a qualified professional. Always seek the guidance of your doctor or another qualified health provider with any questions about your health.

4. Acceptable use

You agree not to misuse Vana. In particular, you will not:

• use Vana for any unlawful purpose or in violation of any applicable law;
• attempt to interfere with, disrupt, or gain unauthorized access to the app or related services;
• use the app in any way that could damage, disable, or impair it.

5. Intellectual property

Vana, including its name, mascot, design, code, and content, is owned by Lodehed Labs and is protected by intellectual-property laws. These Terms grant you a licence to use the app; they do not transfer any ownership rights to you. The data you create in Vana remains yours.

6. Disclaimer of warranties

Vana is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that it will meet your requirements. Nothing in these Terms limits any statutory rights you may have as a consumer that cannot be excluded under applicable law.

7. Limitation of liability

To the maximum extent permitted by law, Lodehed Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of (or inability to use) Vana. Where liability cannot be excluded, our total liability is limited to the amount you paid for the app, if any.

8. Apple-specific terms

The following terms apply because Vana is distributed through Apple’s App Store. You acknowledge and agree that:

• The agreement is with us, not Apple. These Terms are between you and Lodehed Labs only, not Apple. Lodehed Labs, not Apple, is solely responsible for Vana and its content.
• Scope of licence. The licence granted to you is limited to a non-transferable licence to use Vana on Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
• Maintenance and support. Lodehed Labs is solely responsible for providing any maintenance and support for Vana. Apple has no obligation to furnish any maintenance and support services.
• Warranty. Lodehed Labs is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If Vana fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to Vana.
• Product claims. Lodehed Labs, not Apple, is responsible for addressing any claims relating to Vana, including product-liability claims, claims that Vana fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar legislation.
• Intellectual property. In the event of any third-party claim that Vana infringes that party’s intellectual-property rights, Lodehed Labs, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “last updated” date above. Significant changes will be reflected in the app or its release notes. Continuing to use Vana after a change means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of Sweden, without regard to its conflict-of-laws rules, and subject to any mandatory consumer-protection rights in your country of residence.
